Criminal Damage Act 1971

1971 CHAPTER 48


An Act to revise the law of England and Wales as to offences of damage to property, and to repeal or amend as respects the United Kingdom certain enactments relating to such offences; and for connected purposes

[14th July 1971]

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows

1 Destroying or damaging property

(1) A person who without lawful excuse destroys or damages any property belonging to another intending to destroy or damage any such property or being reckless as to whether any such property would be destroyed or damaged shall be guilty of an offence.

(2) A person who without lawful excuse destroys or damages any property, whether belonging to himself or another—

(a) intending to destroy or damage any property or being reckless as to whether any property would be destroyed or damaged; and

(b) intending by the destruction or damage to endanger the life of another or being reckless as to whether the life of another would be thereby endangered;

shall be guilty of an offence.

(3) An offence committed under this section by destroying or damaging property by fire shall be charged as arson.

Well, seeing as how it's cinder and ash, I doubt he'll be burning it again any time soon...besides, what's done is done. No one in the Ministry has seemed to mind, aside from you, so let's just all put it behind us, yeah?

(ps. Up to date or no, few things from the 70s bear mentioning, least of all laws. Witches wore their hair in wings back then, I'm sorry to say. Are you truly willing to trust the judgment of a decade that allowed such atrocities to pass?)

No-one in the Ministry, aside from myself, was at the aforementioned party, so this probably had some bearing on whether or not anyone 'minded', so to speak. Regardless, I am not averse to simply allowing this incident to be forgotten provided the parties involved are more careful the next time they feel an urge to do something destructive. Alas, I feel I am speaking to the unconcerned anyways, so I might as well save some frivolously spent time and put my efforts toward something more worthwhile.

I will let the matter go. I feel as if I have done all I can anyways.

(PS. You may have a point with the hair, Ginny. However, I can hardly help it if this Act has not been updated since before I was born.)
